Minutes of the June 12, 2006 Conference Call

1- Next Meeting

At least one additional meeting will be needed to finish reviewing the draft on Uniform Case Naming Guidelines. It is scheduled to take place on June 19, 2006 at 13:00 EDT.

2- Short Announcements

The Committe welcomes a new member: Alisa Posesorski, VP Editorial from Irwin Law. Ms. Posesorski has extensive experience in legal publishing and was part of the team that developed the CLIC standards for case identification.

3- Review of the draft on Uniform Case Naming Guidelines

"2.3.3 Department, Agency, Board or Office"

The decision with regards to the last example was postponed until this meeting and after much discussion; the Committee is in favor of adopting the following structure for public officers appointed under an Act for which no government entity is named:

Thus, with this new structure, the last example will now be:

"2.4 Court or Tribunal"

After having discussed other options, the decision is to keep the rule as is.

"2.5 Individual Acting in an Official Capacity "

The example with regards to First Nations will be modified to include Ruth's suggestion to "to never require a descriptor for the Chief, and always require a descriptor for other members". Thus, a new example will be used in the document such as:

"3.1 Adversarial Form"

No comments were given on this particular section.

"3.2 Non adversarial Form"

First, it is decided that with regards to the example involving an adopted child, the name of the child will be cited with initials. Thus, Jonathan Smith will read "J.S." since this is the rule in most jurisdictions.

Second, with regards to the "Re", the Committee was divided as to where to place it. Finally, a majority of the members decided that it would be inverted and in between parentheses.

"3.3 Many cases listed"

The Committee adopts Ruth's suggestion to clarify the rule by adding: "When a decision at the trial level involves many cases, the short style of cause refers only to the first listed."

"3.4 Persons representing others"

Following Ruth's suggestions with regards to this section, the Committee is in favor of adding cross-references to Rule 5.3 on Bankruptcy Proceedings as well as to rule 2.1.2 on Executors of Wills.

Also, it is decided that the examples contained in this section will present full decision's headings instead of names of parties only.

Part II: "4. Uniform Protection of identities"

The Committee is in favor of keeping this rule as it is.
