Minutes of the June 5, 2006 Conference Call

Review of the draft on Uniform Case Naming Guidelines

"2.2.4 Municipality or Local Community"

The decision with regards to section 2.2.4 is twofold: to modify the present rule and to adopt a list of Government Entities, Crown Corporations and Municipalities. The Committee adopts three modifications to the current draft. It is decided that section 2.2.4 will go under section 2.3 which deals with governmental entities. Also, it is decided that, in order to avoid redundancy, the term "Municipality" in the examples will be dropped if there is already a territorial descriptor in the municipality's title. Thus, the example:

Finally, the Committee decides to remove the examples containing references to Aboriginal entities. A new category including aboriginal entities will be added under section 2.3 about government entities.

With regards to the adoption of a new list, Ruth sent the members of the Committee an example of a list of Government and Municipal Entities. Ruth informs the Committee that the list will greatly contribute to achieving a certain consistency in addition to providing a quick reference as to how to style these names. The Committee agrees that the list is a somewhat a heavy burden but is well worth the risk. The list will be stored and maintained on the CCC's Website.

As to the general working of the list, the Committee establishes that there would be one list per jurisdiction and that one person from each jurisdiction would be appointed to maintain the list up to date. The list will contain the official names or, whenever possible, provide a link to up to date internet resources with official names in each category of governmental entity.

Since the list is meant to demonstrate how to implement the present norms, the structure adopted in the list is meant to reflect the same structure found in Section 2.3

"2.3 Crown or Government body"

First, with regards to this section is the modification of the title. Thus, Section 2.3's title is now "Government Entities". Second, the new structure of the section is:

Following Ruth's suggestion, the Committee agrees that we should clarify that this section applies to Canadian entities and thus, add a cross-reference to Rule 7 on Foreign Countries in the introductory paragraph.

"2.3.1.1 Criminal Proceedings"

The Committee agrees with Michael and Ruth's suggestion that for Municipal by-law offenses, quasi-criminal municipal prosecutions should be styled "Municipality v. Defendant" when the Crown is not present. Furthermore, the Committee agrees that where a private prosecutor is forced to initiate a prosecution when the Crown refuses to do so, the private prosecutor's name is used rather than R.

"2.3.1.2 Civil Proceedings"

No comments are given on this particular section.

"2.3.3 Department, Agency, Board or Office"

The Committee agrees to remove "and names of specific services or communities" from the rule because it seems to be more confusing than anything. Also, even if it is not the current practice, the publishers acknowledge that, for the sake of clarity, the terms "Department of" and "Ministry of" should be omitted as stated in the draft.

The Committee will try to come up with a more appropriate solution to replace last example as well as the Note about administrators appointed under an Act and where no branch of government is named.

At least one additional meeting will be needed to finish reviewing the draft on Uniform Case Naming Guidelines. It is scheduled to take place on June 12, 2006 at 13:00 EDT. Thus, the discussion on the remaining issues will be addressed at the next conference call.
